By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. We may update these Terms from time to time as described in Section 16; your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Dial My Tone is an informational tool that uses artificial intelligence to generate suggested guitar tone presets, signal chains, and device settings based on inputs you provide. Outputs are suggested starting points intended to help you dial in a tone faster. They are not professional audio-engineering, electrical, or safety advice, are not guaranteed to be accurate, complete, compatible, or fit for any particular purpose, and may not reflect the exact behavior of any specific device.

You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is accurate.

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate information, keep it current, and notify us promptly of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your account.

Paid plans are billed in advance on a recurring basis (for example, monthly or yearly) through our third-party payment processor. By subscribing, you authorize us and our processor to charge your payment method on each renewal date until you cancel. Subscriptions automatically renew at the then-current price unless cancelled before the renewal date. Prices, plans, features, and usage limits may change; where required, we will provide notice, and changes apply to subsequent billing periods. You are responsible for any applicable taxes.

You may cancel at any time; cancellation stops future renewals and your access continues until the end of the current paid period. Except where a non-waivable right to a refund is required by applicable law, all payments are non-refundable and we do not provide refunds or credits for partial periods, unused generations or saves, or downgrades. Usage allowances do not roll over between billing periods.

You agree not to, and not to permit anyone to:

• use the Service for any unlawful, infringing, or harmful purpose;
• reverse engineer, decompile, scrape, harvest, or attempt to derive source code, prompts, models, or underlying data, except where such restriction is prohibited by law;
• resell, sublicense, or commercially exploit the Service or its outputs except as expressly permitted;
• interfere with, overload, or circumvent the security, rate limits, or intended operation of the Service, or access it through automated means without our consent;
• upload or transmit content that is unlawful, infringing, malicious, or that violates the rights of others.

We may investigate and take appropriate action, including suspending or terminating accounts, for any actual or suspected violation.

You retain ownership of the inputs you submit (such as song, artist, gear, and preference details). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and use those inputs and the resulting outputs as necessary to operate, secure, improve, and develop the Service, including processing through the third-party providers described in our Privacy Policy. You represent that you have the rights necessary to submit your inputs and that doing so does not violate any law or third-party right.

Outputs are generated by automated systems and are provided for your convenience on an “as is” basis. They may be inaccurate, incomplete, or unsuitable, and similar inputs may produce different results. You are solely responsible for reviewing, testing, and exercising your own judgment before applying any setting. We make no representation that any output is original, non-infringing, or free of similarity to third-party material. To the extent we hold any rights in outputs generated for you, we assign them to you subject to these Terms; we may generate similar or identical outputs for others.

The Service, including its software, design, text, graphics, logos, trademarks, model libraries, and compilations, is owned by Dial My Tone or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. All rights not expressly granted are reserved. Third-party names, devices, and trademarks are the property of their respective owners and are referenced only for compatibility and identification; their mention does not imply affiliation or endorsement.

The Service relies on third parties — including AI providers, hosting and database providers, a payment processor, and music-metadata sources — and may contain links to third-party sites. We do not control and are not responsible for third-party services, their availability, or their terms and practices. Your use of them is at your own risk and may be governed by their own agreements.

THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that outputs will be accurate or reliable.

Audio and equipment safety is your responsibility. Tone suggestions may involve high gain, volume, or settings that can produce loud output. You assume all risk to your hearing, instruments, amplifiers, speakers, monitors, and other equipment, and you agree to use appropriate caution and protective measures. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIAL MY TONE AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR DAMAGE TO EQUIPMENT OR HEARING, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100. These limitations apply to the fullest extent permitted by law and form an essential basis of the bargain.

You agree to defend, indemnify, and hold harmless Dial My Tone and its affiliates from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to your inputs, your use of the Service or outputs, your violation of these Terms, or your violation of any law or third-party right.

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms or to protect the Service or other users. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive — including Sections 8–14 and 17–18 — survive termination.

We may modify, suspend, or discontinue any part of the Service at any time. We may also revise these Terms; when we do, we will update the “Last updated” date above and, where required, provide additional notice. Your continued use after changes become effective constitutes acceptance.

These Terms are governed by the laws of the jurisdiction in which Dial My Tone is established, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the dispute informally for at least 30 days.

To the extent permitted by applicable law, any dispute not resolved informally will be resolved by binding individual arbitration rather than in court, and you and Dial My Tone waive any right to a jury trial and to participate in a class or representative action. Where arbitration or such waivers are not permitted, the dispute will be resolved exclusively in the competent courts of our jurisdiction, and you consent to their jurisdiction and venue. Nothing in this section prevents either party from seeking injunctive relief for intellectual-property or unauthorized-use claims.

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect and the unenforceable provision will be limited to the minimum extent necessary. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
